Hey guys, I posted about this a while ago, but nothing has been resolved, so my question is mostly is it too late to seek legal action?

Backstory:  My boyfriend and I rented an apartment from Nov of last year to May of this year, and when we moved in it was painted and the carpet was stained and all.  We moved in "as is," being promised that we wouldn't have to pay for it, but that wasn't written in our lease (it was our first place and we didn't know to do that).  So they never sent us our security deposit, and we had this big ordeal over them sending us the itemization (a month late) and us not having done the damage, and we looked up some SC state laws and it says if they don't send the itemization within 30 days of moving out, we get 3 times the amount they owe us (which would make it $750).

So.  We have to prove that we didn't paint the apartment.  I have pictures that I uploaded to Photobucket like, four days after we moved in.  I don't know if that's good enough.  We have many, many people who will testify that we moved into a painted apartment.  I don't know if that would stand up in court.  I don't even know if we have a case.  Or if it's too late to do anything.

So, Internets, I ask you these questions.
1)  Has too much time passed for this to go anywhere?
2)  Will my proof (pictures, testimony, the date printed on the itemization and the paper that says that they did indeed have our correct address) stand up if it goes to court?
3)  Do I actually have to formally sue them or what?  What course do I take?

I'm sorry if this is too vague.  I can provide more info, I just didn't want to bore everyone.  ANY AND ALL advice is appreciated - anything you have to say, toss it out there.  Please.  This has been going on for like, five months.  Please help me.

Hello Everyone-
I need some legal advice concerning a now ex-roommate. He and my other roommate broke up and he moved out. However, he hasn't come back to get his name off the lease or to pick up the rest of his stuff. I'm not sure where he's staying. He also owes me for last month's rent and utilities. Is there any free/cheap place that I can seek legal advice regarding what to do about him paying me back & what to do about his stuff he left? What are the small claims and abandonment procedures like in Arizona (specifically Tucson)? Thanks.

Alright, I live in Indiana and my boyfriend lives in Missouri. He has a ex girlfriend who also lives there. When he and I first got (back) together, I was going to attempt to be friends with her seeing as he felt we should all just get along. She ended up with my phone number (that's what friends do, right?). Now that she's horribly angry with me (because he won't leave me for her) she's using it for pure evil.

I am recieving texts which read things like "I would first like to start by saying fu** you you stupid whore. You deserve to fall off a cliff and die. I hope you get AIDS and die... o wait, you prob already have it. I hope you get the sh** beat out of you. Fu** you you co** sucker. Please do me a favor and die" I have five or six texts like that and a few messages from myspace/facebook where they (she and a few friends) have threatened to "kick your a**"

Along with the texts, since October 11, I have 42 missed calls and 10 recieved calls from her (whose number I have saved in my phone) and the people she has texting me/restricted number. Google tells me this is considered harassment in both our states. The calls/texts are causing me a great amount of distress.

I started out by going to the city police where I live. They sent me to the county because I live in the middle of no where. They then told me I would have to go to Missouri to get anything done. While I understand the crime is being committed there I don't feel like I should have to drive 5 hours to get this taken care of.

I know I should "just change your number" and "block her/them on facebook/myspace/email" ... I don't want to change my number as I'm looking for a job and have given my number out to many potiential employers. And I have blocked each and every person involved who has messaged me via myspace/facebook/email, but they just keep making up new accounts. Verizon (who my phone is through) does not block individual numbers or text messages. I feel like I'm at a loss here.

I honestly just want her/her friends to not be able to (by law) contact me in any way, shape, or form. It's really gotten out of control. I've dropped into a deep depression (dropping classes in school/ dreading waking up/ so on so forth) all from this.

So, do I have to go to Missouri? What all can I have done so she can't contact me?

Google is failing me tonight so I have come to ask the ever opinionated folks here at [info]law_questions!

Other than Canada, are any of you aware of countries that can exclude Americans from entering due to DUI/DWI conviction? Countries that will under special conditions?

*Disclaimer: I do not have said conviction, I am merely writing a blog and would like to have all the facts.

ETA: Sorry, I thought this was common knowledge and there are plenty of websites that talk about it. If you're doubtful, here is website that talks about it. I do also have personal experience with seeing a friend be turned away at the border due to a 4 year old conviction.

I started receiving bills for a Us Weekly magazine subscription earlier this year. I never ordered it and I couldn't find any phone numbers to contact them about it, I did find an email address and tried to contact them that way and never got any response. I obviously don't want to pay these bills. I got a letter from a collections agency asking me to pay. I called the number on it and it's just a recording asking me to pay.

Here's the thing... the bills are coming to my fake name. I use this name online and rarely share my legal name anywhere unless I have to. Do I even have to worry about this since it's not in my name? If I just ignore the letters what other steps will they take?

Hello,
I am renting an apartment in Boston, MA (Brighton specifically) that does not have heat or hot water included in the rent. The heat/hot water is heated by gas which is then fed to radiators and we control the temperature via thermostat in our unit. We are located on the second floor of a three floor building (it's a giant house). Three of the radiators in our apartment have pipes that are connected to the radiators and then continue to go up into the ceiling and presumably connects to radiators in the unit above ours.
Let's say that hypothetically we find out that we are indeed heating the unit above ours and have been paying for the gas to heat our apartment AND theirs. What are our rights? Do you think we would have legal right to request money off of our rent monthly or to break our lease if it came down to that?

Opinions are like assholes and there are way too many on parade lately. The level of discourse in this community has been heading downhill for some time. The comments to the last post are too much.

You people who came out ranting: ITS DUI, HE'S A SCUMBAG -- Oh, pul-leaze. Your reactionary thoughless screeching adds nothing to the discussion, isn't responsive to the original post, and isn't welcome here. Call this the "Judgmental prick? Keep it to yourself" rule.

So when you register a car, are you allowed to use an out of state P.O. Box on your registration?  I was involved in a hit and run accident and when we gave the license plate number of the offending car to the police, it came up as having WA license plates, but being registered to a P.O Box in Nebraska.  So apparently it is allowed, but I just don't get why.  I thought part of the whole reason of registering cars was so if they did something illegal the police would actually have some information to go on to find the person the car belongs to.  When you have a P.O. Box does the post office even have your contact information on file (and do they verify that it is the correct contact information by looking at ID) or are you able to put down pretty much whatever you want and make yourself untraceable by the police if that's what you want to do?

The car that was registered to the license plate number also came up as being a different make and model than the car that hit us, which did make me wonder if we somehow got the number wrong (don't think so since there was three of us that saw it and we had a bit of time to look at it because the driver didn't drive off until we tried to call the police) but either way there is still a car out there with WA license plates registered to a P.O. Box half way across the country and I just want to understand why the DMV would have allowed such a thing. Any insight?

Questions on weight of issues:

1.If an earlier appeal (or similar appeals) of an arbitrary administrative decision were all based on what was
later ruled by the same body
to indeed be an arbitrary application, does the constitutional issue of due process outweigh the previous rulings (all based on the same now admitted errors of fact),therefore making the previous rulings non-binding, therefore null?

2. Does the affirmation of the constitutional issue, validated under testimony by the governing body (appeals board), yet ruled they must dismiss the appeal on technical statue of limitations grounds, take precedence (extra weight/stricter scrutiny) over the technical issue?

According to the Code, the next step allowed is to appeal the decision of the Board to Superior Court within 30 days, but we do not want to specifically do that because even though the motion passed had wording that the board did find the decision arbitrary, we feel the technical issue is not one we want to bet the bank on.

What we want to do is file a due process complaint and have a judge review not what the board ruled, but on the facts of the case and the evidence presented in this public hearing, and make a ruling on the due process question.

Any learned opinions (besides 'get a lawyer' we are already there) would be appreciated. Feel free to ask any details I did not provide. (although the question is broad enough that it does not matter)

I note with interest that many web sites have, as part of their terms of service, that robotic crawling of their sites is a prohibited action. This leads me to ask:

1. If you're not a member of that site, isn't that prohibition not applicable to you?

2. If this is enforceable, whither Google?

In other words, if I wanted to make my own search engine, would a web site's particular terms of service that state, "robotic scanning of this site is prohibited" impose any requirement or prohibition on me? Presume that the information I offer is no more nor less than that already available at Google or any other search engine.

3. Is there any legal guidance on robots.txt yet? Is there any case law requiring that it be honored in any fashion? Or is the concept, "Look, these pages are freely available to the public, so I'm going to look at them" in control?

I've worked a very low level job at a nonprofit organization for about 6 months now, though I have a background that indicates I can do much more.

I've been grateful for having any job at all, but I'm ready to try and move up. I contacted an executive that I know there and she recommended I contact one of her colleagues, which I did. Her colleague wrote back and said that she would be delighted to meet with me to discuss other opportunities. We have a meeting scheduled in a couple of days. Now I'm trying to prepare for the meeting and I have no idea what to talk with her about. I've never met this particular executive, I've asked around about her so I have an idea of what she does. There's no information about her on the organization's website. I know I want to show her that I'm versatile and have a lot to offer, but I've never had this sort of meeting before - only traditional job interviews. Has anyone ever done anything like this? Any tips you could offer would be tremendously appreciated.

Question for those who are knowledgeable about the GPL.

If a software company releases a commercial product under a proprietary license and by virtue of the product being PHP the source is readable, and it is shown (and acknowledged by the company, in fact) that the product contained GPL code, does that make the product, itself, GPL?

What if the company says, "Oops. We included that code by mistake. We have removed the portion of the product that had the GPL code in it. That portion is now GPL, but the rest of the product is not?"

My reading of the GPL says that this argument has been tried and failed to hold water.

Anyone know for sure and/or have any pointers to GNU Foundation positions on this issue?

Many thanks for your comments to my last question about same sex marriage in Ontario. I Googled it, and found that the Supreme Court of Canada ruled same sex marriage constitutional in 2004.
